Banks must Constantly Adapt to Revised or New AML Legislation
Changes to AML regulations in Switzerland have been introduced over recent years through different laws and international agreements:
- 2020: Revised Agreement on the Swiss banks’ code of conduct with regard to the exercise of due diligence (CDB 20).
- 2023: Revised FINMA Anti-Money Laundering Ordinance (AMLO-FINMA)
- 2023: Revised AMLA and amended Anti-Money Laundering Ordinance (AMLO)
- 2024: Bilateral agreement of cooperation with Panama to fight financial crime and in particular money laundering, financing of terrorism, and bribery and corruption. Mutual legal assistance agreement with other countries such as Indonesia and Kosovo since 2018.
- Reinforcement the integrity and competitiveness of Switzerland utilising a federal register of beneficial owners and due diligence for particularly risky activities in legal professions.
- 2024: Swiss Financial Intelligence Public–Private Partnership (Swiss FIPPP), consisting of 12 financial institutions and MROS, officially became operational.
- 2024: Approval of a law to improve transparency of legal entities and identify beneficial owners from the Swiss Council of States. Now under review by the National Council, the register aims to prevent the misuse of companies for money laundering or hiding assets. Implementation is expected in 2025.
